In order to use the Who Remembers Me service you must first agree to all the terms and conditions detailed here.

When you sign up, or each time you log on, you agree to the following terms and conditions, which should be read and understood fully. You should also read the site's privacy policy.

DEFINITIONS

Service or Site: Means the use of this site and all it's features.

We or Us: Means Who Remembers Me and any affiliated services heirs or assigns.

You: means you the registrant and/or user.

Attendances: Information submitted to the site pertaining to places you used to or currently attend.

Display Names: Any names or aliases submitted to the site you wish to use for your Attendances.

Profile: A paragraph of information about you.

THE SERVICE

You must first register in order to use the service, and a further payment is required in order to send messages to other registered members. Registration is free, and payment is optional. There is a nominal charge for Full membership of Who Remembers Me. Please see the main web-site for the different cost options for each country.

OUR AGREEMENT WITH YOU

The service will be provided subject to this Agreement. The headings provided herein are for convenience only & do not affect the construction of this Agreement. You agree that use of this Service is subject solely to the terms provided herein. These terms may vary from time to time and you agree to check them periodically.

USER SUBMISSIONS

We reserve the right to use remove or change any submissions to us, You agree that submissions to this site are intended to be published and you give your consent to such publication.

YOUR USE OF THE SITE

Membership and use of this Site is subject to this Agreement. Violation of these terms and conditions, or acts that may cause harm to the site shall entitle us to terminate your membership.

You may only use the Service for lawful purposes. In particular you may not use the Service to transmit defamatory, offensive or abusive material or material of an obscene or menacing character, or in breach of copyright or any other intellectual property rights, or in contravention of the Computer Misuse Act 1990.

You agree to keep the information you submit to Site up to date and relevant. Information such as e-mail addresses, Attendances and Display Names.

SECURITY

You must not disclose your account details to any other persons.

AVAILABILITY

From time to time the Service may have to be suspended without prior notice. If this ever happens we will endeavour to restart the site as quickly as possible in such circumstances. We cannot be responsible for any consequences that you may suffer as a result.

TERMINATING THE SERVICE

Once registered, you may remove your registration at any time. It is your responsibility to remove your own registration. There is a process in place that will enable you to do this at any time you so require. After completing this process you and any information relating to you will be completely removed from our site and database as if you had not registered in the first place. Any periodic billing subscriptions that are in place will be cancelled from this point forward. This procedure is irreversible and should you change your mind after deleting your account then you will need to complete the registration process again.

LIMITATION OF LIABILITY

Save to the extent excluded by law we accept no liability for any loss or harm or other disadvantage consequent upon the use of this Site, whether or not advised of such consequence or risk of consequence.

We accept no liability arising from inability to gain access to the Service as a result of routine or emergency maintenance on the system or excessive demand for the Service.

You indemnify us from any damages or costs arising from use of the Site.

CHANGES TO THIS AGREEMENT

We may change these terms and conditions at any time by changing or removing existing terms or adding new ones. We will tell you about any changes by posting an updated version of these terms and conditions on our web site. We shall notify you of the changes by an email to the address you supplied at registration and you may cancel the Agreement if you do not accept the terms & conditions. Any change we make applies from the date we post it on our web site.

DATA PROTECTION & PRIVACY

We agree to conform to the requirements of the Data Protection Act 1998 and our stated privacy policy.

We may gather store process and use information on you on based on the forms cookies or IP addresses you submit to us. You agree to such storage processing and use provided it is conformant with the terms of this data protection and privacy clause and the said Data Protection Act.

Certain details and information provided by you will be monitored from time to time and may be disclosed to the police and Law Enforcement Agencies for the purpose of fraud detection, crime prevention and national security. Our records on you may be supplied to those agencies or such others bodies or agencies or persons as required and permitted by law or regulation and in accordance with this Agreement.

You agree for us to publish on the site any Attendances, Display Names or Profiles you may post on the site. You understand that this information will be viewed by other users on the site. However, there will be no visible link on the site between your display names.

Who-Remembers-Me.com and it's partners may from time to time wish to send you special offers or other promotional material via e-mail.

If permission is granted to send you promotional emails from ourselves and carefully selected 3rd parties in return for free membership to this site, then for you to unsubscribe from these mailings/future mailings you will need to delete your account with us. It is the responsibility of the registrant to delete their own account.

YOUR CONDUCT AND RESPONSIBILITIES

We expect our users to exercise good manners and consideration when using this site. You are solely responsible for all content you publish on the site. Who Remembers Me accepts no responsibility for any consequences incurred by the use of the site, or for any of the content added by its users.

Who Remembers Me does not actively monitor e-mails and is not responsible for any contacts which take place. While we cannot and do not review anything posted to or by the site, and are not responsible for the content of these messages, we reserve the right to delete, move, or edit messages that we determine violate the following guidelines:

You are not allowed to distribute, upload or publish anything that is defamatory, libellous, pornographic, obscene or abusive, promotes hatred, violence or illegal conduct or that otherwise violates any law or the rights of another.

We do not accept any responsibility for arrangements made between the parties concerned and cannot act as an intermediary. While we take precautions over those registering with us these are very limited and we cannot vouch for the veracity or integrity of users on this Site. If you agree to meet or correspond with others you must take advice and decide for yourself on the safety of doing so.

You agree not to send unsolicited e-mails to users of this Site.

ABUSE

If you feel abused, or if you have a problem with the conduct of another Site user, you should contact the Who Remembers Me support department where further action can be arranged.

We will investigate the matter, review all reported messages and, if appropriate, remove them.

PAYMENT OF SERVICE

While the majority of our site remains free to use, we have a varition of account types, the standard upon registration remaining free from charge and the other known as full membership.

Payment is not a requirement for useage of all our websites facilities, by paying a levied fee, you agree you wish to have access to the additional function which includes but not limited to the sending of

messages to other users you find in our database. Messages are sent only within the website and you can not obtain any additional information unless the recipient has provided you with such content

in a reply message. By paying through our website you acknowledge you take soul responsabilty on the reasons why we will debit your account with a sum of money which is provided to you before you make a transaction and

that you are either the owner of the credit/debit card or have been given permission by the account holder. We do not store credit information within our database and we do not do continued payments, when your 'full membership'

account expires, it is entirely up to yourself to renew it, we will not take any more money from your account, you will have to follow through to the payment screen once again.

JURISDICTION

The Visitor agrees that this Agreement for the use of the Service is subject to the laws of England and Wales and to the exclusive jurisdiction of the High Court in the Strand, London.

We do not publish contact details of any user registered on the site. However, if you choose to contact someone, you agree that your e-mail address and a Display Name of your choosing should be disclosed to the person you wish to contact. Who Remembers Me accepts no liability for problems incurred due to information errors, mistaken identities or any other problems which may occur as a result of using the Service's contact features.
